XHK Fined HK$2.5M by Hong Kong SFC Over Capital and Client Money Breaches

Between March and April 2021, XHK transferred up to HK$206 million from segregated accounts to overseas brokers without written direction or standing authority, as required under the relevant client money rules.
In a separate issue, between February 2019 and October 2021, the firm failed to move non-client money out of segregated accounts within the required timeframe after identifying it as such. The amount involved included about HK$38 million in commissions and interest.
The SFC said these failures also breached the Code of Conduct. In setting the penalty, the regulator considered factors including the duration of the issues, remedial steps, cooperation with the investigation, and the absence of reported client losses.
